5. הזכות להיבחר
תיקון: תש״ט־3
הזכות להיבחר תהיה לכל אדם, גבר ואשה, שמלאו לו 21 שנה עד יום כ״ט בכסלו תש״ט (31 בדצמבר 1948) ואשר –
(א)רשאי לבחור בהתאם לסעיף 4 לפקודה זו; או
(ב)היה ביום ו׳ בחשון תש״ט (8 בנובמבר 1948) מחוץ לשטח הבחירות והיה בידו באותו יום, או שניתן לו אחרי כן, דרכון של מדינת ישראל או אשרה לשוב לישראל.
אולם העובדה שאדם נמצא במועד הבחירות בבית כלא לא תשלול ממנו את הזכות להיבחר.
