5. בקשת חכירה
היו המקרקעין משמשים למחזיק ביום הקובע מקור עיקרי למחייתו ולמחיית בני־ביתו, ואין לו מקרקעין אחרים כדי מחייתם, רשאי הוא לבקש שיוחכרו לו מקרקעין כדי מחייתו ומחיית בני־ביתו; נמסרה לו הודעה כאמור בסעיף 4 יגיש בקשתו תוך שלושים יום מיום מסירת ההודעה.
