בהתחשב עם הוראות תקנות אלה, על בתי המשפט של ישראל להכיר בחוקיותן של פעולות בלתי־משפטיות המפורטות בתקנות אלה לכשנקט בהן קונסול של מדינה אשר נתיניה כפופים לשיפוטם האזרחי והפלילי של בתי המשפט בישראל:
בתנאי שהקונסול נקט באותן פעולות בתוקף חוקה של המדינה שמינתה אותו ובהתאם לאותו החוק.
