3. עובד הציבור לשעבר
האיסור חל גם על מי שהגיעה אליו ידיעה בתוקף תפקידו כעובד הציבור וחדל לאחר מכן להיות עובד הציבור, אולם האיסור לא יחול אם נתקיימו שלושה אלה גם יחד:
(א)חלפו חמש שנים מהיום שחדל להיות עובד הציבור;
(ב)הידיעה אינה נוגעת לבטחון המדינה או ליחסי החוץ של המדינה;
(ג)במסירתה אין משום פגיעה באינטרס ציבורי או בזכות של פרט.
