1. פטור במקרים מיוחדים
מתן אשרה ורישיון ישיבה לעובדים זרים המפורטים להלן, אינו טעון היתר לפי סעיף 1יג לחוק עובדים זרים, התשנ״א–1991:
מי שזכאי לאשרת עולה או לתעודת עולה לפי חוק השבות, התש״י–1950, ורוצה לשהות עד חמש שנים בישראל, כדי לבדוק את האפשרות והתנאים להשתקעות בישראל כעולה.
