39. השתתפות רשות מקומית
(א)רשות מקומית המיוצגת ברשות רשאית להגיש הצעות מחירים לביצוע עבודה אם הודיעה בכתב לרשות ולועדת המכרזים על כוונתה להגיש הצעות כאמור לפני הישיבה הראשונה בה ידונו בהצעה. הוראה זו חלה גם על תאגיד שרשות מקומית כאמור חברה בו.
(ב)נציגה של רשות מקומית כאמור לא ישתתף בדיונים על הצעות בועדת המכרזים ולא יצביע בכל הדיון בה.
