לא ימונה למנהל הכללי של הרשות מי שהורשע בעבירה שמפאת מהותה, חומרתה או נסיבותיה אין הוא ראוי לכהן כמנהל הכללי של הרשות או שהוגש נגדו כתב אישום בעבירה כאמור וטרם ניתן פסק דין סופי בעניינו.
