10. בקשה לכפירה בסמכות מכוח המצאה מחוץ לתחום המדינה
תיקון: תשפ״ג
הומצא כתב טענות לנתבע באמצעות המצאה מחוץ לתחום המדינה כאמור בתקנה 8 או באמצעות המצאה אליו בעת שהוא הגיע לישראל ושוהה בה לצורך דיון ראשון במסגרת ההליך (בתקנה זו – ההליך), רשאי הוא לכפור בסמכות בית הדין לדון בתובענה או לטעון כי הפורום הישראלי אינו הפורום הנאות לדון בתובענה, באמצעות הגשת בקשה לגבי עניין זה לא יאוחר ממועד הדיון הראשון שייקבע על ידי בית הדין במסגרת ההליך.
