4. סייג לגבי תקופת ההגנה
על אף האמור בסעיפים 2 ו־3 תהיה תקופת ההגנה הניתנת בישראל ליצירות האמורות באותם סעיפים מוגבלת –
(1)לגבי יצירה שפורסמה – לתקופת ההגנה הקבועה ליצירה מאותו סוג בארץ הפרסום הראשון;
(2)לגבי יצירה שלא פורסמה – לתקופת ההגנה בארץ נתינותו או אזרחותו של מחברה.
