19. ביטול ושינוי תנאי בבית משפט
(א)מצא בית משפט, בהליך שבין ספק ולקוח, שתנאי הוא מקפח, יבטל את התנאי בחוזה שביניהם או ישנה אותו במידה הנדרשת כדי לבטל את הקיפוח.
(ב)בהשתמשו בסמכותו לפי סעיף קטן (א) יתחשב בית המשפט במכלול תנאי החוזה ובנסיבות האחרות, וכן בנסיבות המיוחדות של הענין הנדון לפניו.
