2. מעמד הכללים
(א)כללים אלה מתווים עיקרים ועקרונות להתנהגותם ולאורחותיהם של רשמי ההוצאה לפועל, ומהם ייגזרו כללי אתיקה ספציפיים בכל מקרה ומקרה.
(ב)אין הכללים באים לגרוע מן האמור בתקשי״ר או בכל דין. בכל עניין שאינו נדון מפורשות בתקשי״ר, בכללי האתיקה לעובדי המדינה או בכללים, ינהג רשם ההוצאה לפועל בהתאם לרוחם ולמגמתם של הכללים ובהתאם לנורמות אתיות כלליות.
