לעותר 2, המועסק על-ידי העותר 1, הונפקו במשך מספר שנים תעודות עיתונאי, עד שבחודש יוני 2005 הוחלט לסרב להנפיק לו תעודות נוספות. השגה שהוגשה על אותה החלטה נדחתה, ומכאן העתירה שבפנינו.

בתשובתו, טען המשיב, כי הוחלט למנוע מהעותר מעמד של עיתונאי, לאחר שנמצא כי הוא מעורב בפעילות עוינת שיש בה כדי לסכן את בטחון המדינה. עוד נטען, כי הנפקת תעודת עיתונאי תאפשר לעותר להיכנס למקומות מאובטחים ולהתקרב לאנשים מאובטחים, ללא בדיקה.

עובר להחלטתנו בעתירה, ובהסכמת בא-כוח העותרים, עיינו בחומר מודיעיני חסוי עליו קיבלנו הסברים מגורמי הביטחון, ומסקנתנו היא כי לא נפל פגם בהחלטה למנוע מהעותר תעודת עיתונאי. אדרבא, נראה כי מ דובר בהחלטה עניינית, ראויה וסבירה, הואיל והנפקת תעודת עיתונאי כרוכה הפעם בהסתברות קרובה לודאי כי תיגרם פגיעה בביטחון המדינה ובשלום הציבור.

אשר על כן, העתירה נדחית.
