המשנה לנשיאה א' ריבלין:

1.לפנינו עתירה המבקשת לבטל את החלטת הממשלה 3690, מיום 29.6.2008, שעניינה החזרתם של החיילים החטופים אלדד רגב ואהוד גולדווסר במסגרת עסקת חילופין עם ארגון החיזבאללה (להלן: החלטת הממשלה ו- העסקה). העותרים הם ארגון נפגעי הטרור אלמגור וכן בני משפחה של קורבנות טרור, ביניהם – בני משפחתו של אליהו שחר ז"ל, שנרצח על-ידי המחבל סמיר קונטאר אשר אמור להשתחרר במסגרת העסקה. המשיבה היא ממשלת ישראל.

במסגרת העסקה שאושרה על-ידי ממשלת ישראל, יוחזרו החיילים החטופים, יועבר לישראל דוח על היעלמותו של רון ארד, וכן יועברו לישראל שרידים של גופות חיילי צה"ל שנפלו במלחמה. בתמורה תשחרר מדינת ישראל את האסיר סמיר קונטאר וכן ארבעה לוחמים בלתי-חוקיים לבנונים המצויים בישראל. עוד תעביר מדינת ישראל ללבנון "גופות חודרים ומחבלים" וכן תעביר למזכ"ל האו"ם מידע לגבי ארבעת הדיפלומטים האיראניים הנעדרים. בהחלטת הממשלה נכתב עוד כי לאחר מימוש העסקה תשחרר ישראל אסירים פלסטיניים שמספרם וזהותם ייקבעו על-ידי ממשלת ישראל לפי שיקול דעתה הבלעדי.

העותרים מעלים שלוש טענות עיקריות כנגד המשיבה: ראשית, כי החלטת הממשלה התקבלה ללא יישום המלצותיה של ועדת וינוגרד בכל הנוגע לטיפול בסוגיית החטופים; שנית, כי החלטת הממשלה התקבלה בלא שנשמעו קודם לכן משפחות נפגעי הטרור ובלא שעניינן הובא בחשבון. שלישית, כי המחיר שישראל נאותה לשלם במסגרת העסקה מופרז ועלול להביא לסיכון חייהם של שבויים בעתיד.

ביקשנו – וקיבלנו – את תגובת המדינה. לאחר שבחנו את טענות הצדדים באנו לכלל מסקנה כי אין מנוס מלדחות את העתירה.

3.כפי שעולה מתשובת המדינה, העסקה נשוא העתירה, שאושרה על-ידי ממשלת ישראל, כבר נחתמה על-ידי הממונה על המשא-ומתן מטעם ראש הממשלה, והיא אמורה להתבצע במהלך חודש זה. מ דובר אם כן בעסקה מוגמרת. המדינה מציינת כי המהלכים האחרונים שנתקיימו במסגרת אישור העסקה היו ידועים זה מכבר והחזרת הגלגל אחור – כפי שמבוקש בעתירה – עלולה לשאת עמה השלכות כבדות-משקל. אין כל ספק כי עניינם של העותרים, המדברים מדם ליבם, לא זו בלבד שהוא נוגע ללב, אלא שהוא גם מהווה שיקול חשוב שצריך להילקח בחשבון ולקבל את המשקל הראוי לו. כאבם של העותרים עמוק וקשה מנשוא. כך גם כאבן של משפחות רגב וגולדווסר. המדינה בתשובתה מבהירה כי כל אלה הונחו על כפות המאזניים. בסופו של דבר התקבלה ההחלטה הנזכרת לעיל אשר משקפת, אליבא דממשלת ישראל, את ההסדר הטוב ביותר בנסיבות שנוצרו ובהתחשב במכלול הנתונים שלעניין.

4.אך מובן הוא כי החלטת הממשלה עוסקת בנושא המצוי בגרעין שיקול הדעת שלה – יחסי החוץ והביטחון של מדינת ישראל. בכגון אלה נוקט בית המשפט מדיניות התערבות מרוסנת עד-מאד. השיקולים הצריכים להישקל במסגרת החלטה מן הסוג שקיבלה הממשלה חורגים אל מעבר ומחוץ לתחום המשפט. תפקידה של הממשלה לקבל החלטות מהסוג הנדון. לה הסמכות, לה המידע ולה שיקול הדעת. כפי שנפסק לפני ימים אחדים, בעתירה שעסקה גם-היא בעסקה נשוא ענייננו: "ענייניה המדיניים ויחסי החוץ של המדינה מופקדים על-פי מהותם בידי הממשלה, והיא הגוף המתאים לעסוק בהם ולנהלם על פי סמכויותיה ותחום תפקידיה" (בג"ץ 5856/08 פרהנגיאן נ' ממשלת ישראל (לא פורסם, 6.7.2008)). ההחלטה שקיבלה הממשלה היא החלטה קשה – מן הקשות ביותר – אולם משנתקבלה לאחר איזון בין מכלול הנתונים והאינטרסים המעורבים, מתחם ההתערבות של בית המשפט הוא מצומצם, ויכולתו להושיט סעד - מוגבלת ביותר (ראו עוד בג"ץ 9290/99 מטה מותקפי הטרור נ' ממשלת ישראל, פ"ד נד(1) 8; בג"ץ 914/04 ארגון נפגעי הטרור הערבי הבינלאומי נ' ראש הממשלה (לא פורסם, 29.1.2004)). בענייננו, עם כל ההבנה לטענותיהם של העותרים, לא עלה בידם להצביע על עילה להתערבותו של בית משפט זה.

יצוין כי הצורך בגיבוש מדיניות עקבית ומושכלת בכל הנוגע לעסקאות חילופי שבויים הוא ברור וניכר, וכי בתשובת המדינה נאמר שהממשלה החליטה לאמץ את המלצותיה של ועדת וינוגרד וכי מתקיימת לצורך כך עבודת מטה במשרדי הממשלה הנוגעים בדבר.

התוצאה היא שהעתירה נדחית.
