החלטה

השופט ס' ג'ובראן:

עניינה של העתירה שבפנינו הוא בבקשת העותרים כי המשיבים ינמקו מדוע לא תבוטל החלטתו של המשיב 1 (להלן: המשיב) משנת 2005 אשר מבטלת את אשרת השהייה הזמנית מסוג א/5 שקיבל העותר 1 (להלן: העותר) במסגרת הליך איחוד משפחות.

העותר הינו אזרח הרשות הפלסטינית אשר נישא לעותרת 2 (להלן: העותרת) ביום 26.4.1995 ולהם ילדה אחת. אלו היו נישואיו השניים של העותר, מאחר וביום 16.4.1995 הוא התגרש מאשתו הראשונה, תושבת עזה.

על פי המידע המצוי בידי משרד הפנים נמסר כי העותר נשא את גרושתו בשנית כבר ביום 12.6.1995, דהיינו פחות מחודשיים לאחר נישואיו לעותרת ועוד בטרם הוגשה הבקשה לאיחוד משפחות בעניינם.

בעקבות נישואיהם, פנו העותרים ביום 13.6.1995 בבקשה לאיחוד משפחות (להלן: הבקשה הראשונה לאיחוד משפחות). ביום 2.9.1998 ניתנה לעותר הפנייה למתקן תיאום וקישור אשר הוארכה מספר פעמים וביום 13.6.2000 הוענקה לעותר אשרת שהייה זמנית מסוג א/5 לתקופה של שנה.

עוד נמסר ממשרד הפנים כי ביום 15.10.2000 נרשמו שני ילדים במרשם התושבים באזור אשר נולדו לעותר מאשתו הראשונה, ילדים אשר נולדו בשנים 1997 ו-1998.

העותר והעותרת התגוררו ברהט עד אשר בשנת 2001 החליט משרד הפנים להפסיק את הליך איחוד המשפחות בעניינם של העותרים. ביום 17.6.2001 נשלחה להם הודעה כי בקשתם סורבה לאור העובדה שהעותר נישא בשנית לגרושתו ונולדו לו ממנה שני ילדים.

המשיב עוד מציין כי בשנת 2003 נרשמו שלושה ילדים נוספים על שם העותר ואשתו הראשונה במרשם התושבים באזור, ילידי השנים 1999, 2001 ו-2002.

יוער כי העותר צירף נספח מאת בית הדין השרעי לערעורים שמאשר את גירושיו בשנית מאשתו הראשונה ביום 3.3.2005.

ביום 17.5.2005 הגישו העותרים בקשה נוספת לאיחוד משפחות (להלן: הבקשה השנייה לאיחוד משפחות), אשר סורבה נוכח הוראות חוק האזרחות והכניסה לישראל (הוראת שעה), התשס"ג-2003 (להלן: חוק האזרחות והכניסה לישראל). יוער כי הבקשה נדחתה עובר לתיקון הוראת השעה (חוק האזרחות והכניסה לישראל (הוראת שעה) (תיקון), תשס"ה-2005) (להלן: תיקון הוראת השעה)), בו נקבעו חריגים להוראות חוק האזרחות והכניסה לישראל.

המשיב מסר עוד כי ביום 11.7.2005 נולד לעותר ילד נוסף מאשתו הראשונה.

בא כוח העותרים טוען, כי מן הדין ומן הצדק לקבל לעתירה לאור נישואיו של העותר לעותרת, החלטתו לנתק כל קשר עם אשתו הראשונה וגירושיו ממנה בשנית ורצונו להתאחד עם בתו, המנותקת מאביה זה מספר שנים.

מנגד, טוען המשיב כי דין העתירה להדחות על הסף מחמת שיהוי היות וההחלטה אשר דחתה את בקשתם הראשונה של העותרים לאיחוד משפחות ניתנה לפני כשש שנים וכי לגופו של עניין ההחלטה התקבלה כדין ובאופן העולה בקנה אחד עם מדיניות המשיב, שעניינה סירובו של המשיב לאשר בקשות לאיחוד משפחות מקום בו מ דובר בריבוי נישואין. עוד מוסיף המשיב, כי אף אם מ דובר בתקיפה של ההחלטה לדחות את בקשתם השנייה לאיחוד משפחות של העותרים, חל שיהוי כבד בהגשת העתירה גם כאן וכי בכל מקרה רשאי שר הפנים כיום, לאחר תחיקת תיקון הוראת השעה, לבחון בקשה בהתאם לחריג הקבוע בחוק האזרחות והכניסה לישראל המאפשר לאשר בקשה של תושב האזור להיתר שהייה בישראל כאשר גילו הינו מעל ל-35 שנים.

דין העתירה להידחות על הסף. העותרים בעתירתם אינם מציינים מפורשות איזו החלטה הם תוקפים, האם ההחלטה לדחות את בקשת איחוד המשפחות משנת 2001 או משנת 2005. אם היה ברצון העותרים לטעון נגד צדקת ההחלטה משנת 2001, היה עליהם להגיש את עתירתם זמן סביר לאחר מתן ההחלטה. משחלפו יותר משש שנים, ולאור העובדה שהם הגישו בקשה חדשה לאיחוד משפחות, דין העתירה להידחות על הסף בכול הנוגע לבקשה הראשונה לאיחוד משפחות.

באשר להחלטה לדחות את הבקשה השנייה לאיחוד משפחות משנת 2005, הרי שבעקבות הוראת השעה לא מאושרות בקשות לאיחוד משפחות, וזאת למעט החריגים הקבועים בסעיף 3 לתיקון הוראת השעה. יש לציין, כי חוקתיותה של הוראת השעה אושרה בבית-משפט זה בבג"ץ 7052/03 עדאלה נ' המרכז המשפטי לזכויות המיעוט הערבי בישראל נ' שר הפנים (לא פורסם, 14.5.2006). העותר שבפנינו הגיש את בקשתו השנייה לאיחוד משפחות בטרם נכנס לתוקף תיקון הוראת השעה, ועל כן החלטתו של המשיב משנת 2005 ניתנה בהתאם למצב המשפטי הקיים ואין מקום להתערב בה.

אשר על כן, העתירה נדחית על הסף.
