עיון בכתב התביעה שהגישה המשיבה 1 מגלה כי למעשה היא תבעה שני סעדים: האחד כספי והאחר סילוק יד. אכן, הסעד הכספי מורכב מפריטים שונים. אף כאשר מצרפים את כולם יחדיו, כפי שצריך לעשות, אין מגיעים לסכום של 2.5 מ' ₪. מכאן, שהן הסעד הכספי והן הסעד של סילוק יד הינם בסמכותו של בית משפט השלום, אשר אליו היתה צריכה התביעה להיות מוגשת ולא לבית המשפט המחוזי. כמובן, שגם האגרה שיש לשלמה תהא על פי הסעדים, ובהקשר לסעד הכספי על פי הסכום המצרפי (ולא לגבי סכום של 700,000 דולר, כפי שקבע בית המשפט המחוזי).

בעקבות הערותי הודיע בא כוחה של המשיבה 1 כי הוא מסכים לבקשה. החלטתי לדון בבקשה לרשות ערעור כאילו ניתנה הרשות והוגש ערעור על פיה. הערעור מתקבל והחלטתו של בית המשפט המחוזי מבוטלת. ההליך, כולל התביעה שכנגד, יועבר לבית משפט השלום בירושלים. הוא ימשיך להתנהל מן השלב אליו הגיע בבית המשפט המחוזי.

אין צו להוצאות.
