כשיר לכהן כיועץ משפטי לכנסת אזרח ישראלי ותושב ישראל הכשיר לכהן כשופט בית המשפט העליון, ובלבד שבחמש השנים הקודמות להצגת מועמדותו, לא היה פעיל בחיים הפוליטיים ולא היה חבר במפלגה כלשהי; לענין סעיף זה, מי שלא שילם דמי חבר למפלגה ולא השתתף בפעילות במוסדותיה, לא יראוהו כחבר מפלגה.
