12. קביעת מועד לשמיעת הערר
(א)יושב ראש הועדה יקבע מועד לשמיעת הערר וישלח הזמנות לעורר ולרשות המוסמכת, ארבעה עשר יום לפחות לפני מועד השמיעה.
(ב)נתברר ליושב ראש הועדה מכתב הערר, מכתב התשובה או מהתיק שאין חילוקי־דעות ביחס לשאלות שבעובדה, רשאי הוא להורות לבעלי הדין לסכם בכתב בדרך הנראית לו, במקום לקבוע מועד לשמיעת הערר, ובלבד שיתן לעורר או לבא כוחו, על פי דרישתם, הזדמנות להשמיע דבריהם בעל פה.
