5. החלפת מכשיר
(א)מתן רשיון לרכישת מכשיר מיוחד חדש, במקום מכשיר מיוחד קיים, מבטל את הרשיון למכשיר הקיים; בעל רשיון למכשיר קיים כאמור, יחזיר עם הפעלת המכשיר החדש, את הרשיון ויודיע בכתב למנהל על השבתתו של המכשיר המיוחד הקיים.
(ב)המנהל לא יסרב לתת רשיון למכשיר מיוחד חדש, המבצע פעולה בעלת אופי רפואי ומטרות זהות, במקום מכשיר ישן אלא בהתחשב בשיקולים רפואיים בלבד.
