5. הודעה על פיגורים והוצאה לפועל
(א)המלווה יודיע בכתב לשר על כל פיגור בתשלומי הלווה לפי תנאי המשכנתה, כל אימת שהפיגור יגיע לסכום השווה לשלושה רבעים מסך כל התשלומים השוטפים המגיעים מהלווה לשנה אחת, תוך ארבעה עשר יום מיום הפיגור.
(ב)המלווה יודיע בכתב לשר לפחות שבוע למפרע על כוונתו להגיש בקשה למכירת הנכסים הממושכנים לשם גביית חוב המשכנתה.
