5. מעמדם של אלה ששירותם לא הופסק
עובד ממשלה או שוטר שסגולותיו נבדקו על ידי ועדת חקירה על פי תקנות עובדי ממשלת ארץ־ישראל (ועדות חקירה), תש״ח–1948, ושירותו לא הופסק, או שועדה שנתמנתה לפי חוק זה החליטה שיש להחזירו לשירות, דינו כדין שאר עובדי ממשלת ישראל, הן ביחס לתנאי השירות והן ביחס לזכות הממשלה לפטרו.
