5. מסירה לנמען
(א)הודעת ההפקעה תימסר לנמען גופו או לבא כוחו על ידי מוסר ההודעה; לא היה הנמען במקום יכול מוסר ההודעה למסור את ההודעה לאחד מבני משפחתו של הנמען הגר עמו באותה דירה או הנמצא באותו בית עסק והנראה כבן 18 שנה לפחות; מוסר ההודעה יאשר על העתק הודעת ההפקעה את דבר מסירתה, ויציין את שם האדם לו נמסרה ואת תאריך המסירה.
(ב)אישור כאמור ישמש ראיה לכאורה לדבר.
