4. החלטה בבקשה והודעה על מתן הוראת פטור
(א)ראה השר כי מתקיימות נסיבות המצדיקות מתן פטור מסעיף 4 לחוק וכי מתקיימים התנאים לפי תקנות אלה, רשאי השר ליתן הוראת פטור למוסד לפי סעיף 5(א) לחוק.
(ב)הודעה על מתן הוראת פטור לגבי מוסד חינוך תינתן לבעל המוסד ולמנהל המוסד וכן לרשות החינוך המקומית שבתחום שיפוטה נמצא אותו מוסד חינוך.
