5. פקיעת הוראה על מתן פטור
(א)הוראה על מתן פטור תפקע אם אין מוסד הפטור מחזיק ברישיון להפעלת בית ספר לפי כל דין.
(ב)השר רשאי לבטל הוראה על מתן פטור אם חדל להתקיים במוסד הפטור תנאי מהתנאים המפורטים בתקנה 3, למעט לעניין רישיון, ובלבד שנתן למוסד החינוך הזדמנות להביא את טענותיו לפניו ולתקן את הדרוש תיקון.
