20. פטור ממכרז
על אף האמור בכל דין, הקניית זכויות בשטח על ידי רשות מקרקעי ישראל לגוף ציבורי לשם תכנון לפי סעיף 7(א) או הקמת בית הרועה והמבנים החקלאיים והתקשרות של גוף ציבורי עם רועה לפי סעיף 17, אינן טעונות מכרז, ובלבד שההתקשרות בין הגוף הציבורי לרועה תהיה לפי המלצת הגורם המוסמך ושהרועה מחזיק בהרשאת רעייה בתוקף מאת רשות מקרקעי ישראל.
