5. אי־הפחתת משכורת לעובד שמשכורתו נקבעת לפי משכורת של נושא משרה
על אף האמור בסעיף 3, לגבי עובד שמשכורתו, כולה או חלקה, נקבעת לפי משכורת של נושא משרה, והקפאת השכר לפי חוק ההקפאה לנושאי משרה חלה לגבי משכורתו בעקיפין, לא תופחת משכורתו לפי חוק זה.
