העושה מעשה או אינו נוקט זהירות סבירה בנכס שבהחזקתו או בפיקוחו וגורם בכך סכנה, מכשול או נזק לאדם בדרך ציבורית או בנתיב שיט ציבורי, דינו – מאסר שלוש שנים.
