185. הרשעה בעבירה שאינה בתחום הסמכות

לענין סעיף 184 אין נפקא מינה שהעבירה שנתגלתה אינה בתחום סמכותו הענינית של בית המשפט, אולם אם נתגלתה עבירה שהיא פשע בבית משפט שאינו מוסמך לדון בו, יעביר את הענין לבית משפט מחוזי, והלה ידון בו כאילו הובא לפניו מלכתחילה, ורשאי הוא לדון בו מן השלב שאליו הגיע בית המשפט הקודם.
