לפני מתן גזר הדין רשאי בית המשפט, לאחר שנתן לנאשם הזדמנות להשמיע טענותיו בענין, לצוות על בדיקת הנאשם בידי רופא או מומחה אחר; ורשאי בית המשפט לצוות על חקירות אחרות הנראות לו מועילות לקביעת העונש.
