הדיון בערעור יהיה בפני בעלי הדין; אולם אם הוזמן בעל דין ולא התייצב, רשאי בית המשפט לדון בערעור לא בפניו, או אם המערער הוא שלא התייצב – לדחות את הערעור מטעם זה בלבד.
