208א. ביטול דחיית הערעור
תיקון: תשמ״ז, תשנ״ה־2
(א)נדחה ערעורו של נאשם בשל אי־התייצבותו יבטל בית המשפט את ההחלטה על דחיית הערעור וישמע את הערעור אם נוכח, על פי בקשת המערער, כי היתה סיבה מוצדקת לאי התייצבות המערער או אם ראה שהדבר דרוש כדי למנוע עיוות דין.
(ב)בקשה לפי סעיף זה תוגש תוך חמישה עשר ימים מיום שהחלטת הדחיה הודעה למערער או תוך מועד מאוחר יותר שהסכים לו בית המשפט.
