5. עבירות שסעיף 23(א) לחוק־יסוד: הממשלה לא יחול עליהן
הוראת סעיף 23(א) לחוק היסוד לא תחול על עבירות אלה:
(1)עבירת תעבורה כהגדרתה בסעיף 1 לפקודת התעבורה, למעט עבירה לפי סעיף 64א לפקודה;
(2)עבירה שנקבעה כעבירת קנס לפי כל חיקוק, שתובע לא הגיש בשלה כתב אישום;
(3)עבירה שנקבעה כעבירה מינהלית לפי כל חיקוק, שתובע לא הגיש בשלה כתב אישום.
