נעלמו מן התובע העובדות המהוות את עילת התובענה, מסיבות שלא היו תלויות בו ושאף בזהירות סבירה לא יכול היה למנוע אותן, תתחיל תקופת ההתיישנות ביום שבו נודעו לתובע עובדות אלה.
