9. הודאה בקיום זכות
הודה הנתבע, בכתב או בפני בית משפט, בין בתוך תקופת ההתיישנות ובין לאחריה, בקיום זכות התובע, תתחיל תקופת ההתיישנות מיום ההודאה; ומעשה שיש בו משום ביצוע מקצת הזכות, דינו כהודאה לענין סעיף זה.
בסעיף זה, ”הודאה“ – למעט הודאה שהיה עמה טיעון התיישנות.
