3. מינוי ללא חוות־דעת לשכת הסעד
על אף האמור בתקנה 2 רשאי בית־המשפט למנות סניגור לנאשם מחוסר אמצעים אף בהעדר פרטים בבקשה, או בלא להעבירה ללשכת הסעד, או אם חוות הדעת וההערות לא נתקבלו תוך 21 יום מיום שהועברה הבקשה כאמור או תוך תקופה קצרה יותר שקבע בית־המשפט, ובלבד שבית־המשפט משוכנע, על פי חקירתו הוא, שהנאשם מחוסר אמצעים.
