בשעת הדיון באבעיה רשאים בית המשפט ובעלי הדין להסתמך על תכנם של המסמכים שפורטו לפי תקנה 235, ובית המשפט רשאי להסיק מן העובדות והמסמכים כל מסקנה, עובדתית או משפטית, שאפשר היה להסיק מהם אילו הוכחו אגב דיון בתובענה.
