אבעיה שפסול־דין הוא בעל דין בה לא תובא לדיון בלא רשות מאת בית המשפט; בקשת הרשות תוגש בכתב ותהא נתמכת בראיות מספיקות, המוכיחות את אמיתות האמור באבעיה בנוגע לענינו של הפסול־דין.
