27. פסק דין לטובת מקצת בעלי דין

לא תיפגע תובענה בשל כך בלבד שבעלי דין צורפו בה שלא כדין או שלא צורפו, אלא רשאי בית המשפט או הרשם לדון בענין ככל שהוא נוגע לבעלי הדין שלפניו למעשה, ומותר ליתן פסק דין, ללא תיקונים, לטובת מקצתם של התובעים שנמצאו זכאים לסעד ולפי זכותם, או כנגד מקצתם של הנתבעים שנמצאו חבים ולפי חבותם.
