מלאו למאומץ תשע שנים או שטרם מלאו לו תשע שנים אך נראה לבית המשפט שהמאומץ מסוגל לכאורה להבין בדבר האימוץ, לא יתן בית המשפט צו אימוץ אלא אם כן נתמלאו הוראות סעיף 7 לחוק האימוץ.
