היה בראיות שבתיק המשפט כדי לאפשר לבית המשפט שלערעור ליתן פסק דין, רשאי הוא לפסוק סופית בתובענה אף אם בית המשפט בערכאה הקודמת הסתמך בפסק דינו על נימוק שונה מהנימוק שעליו מסתמך בית המשפט שלערעור.
