45. על מחזיקי קרקעות שלחין לנקוט באמצעים למניעת גידול יתושים
(1)על המחזיק בקרקעות שלחין או בגני שלחין, או, בהעדר המחזיק, על בעל הקרקעות או הגנים, לנקוט באמצעים הדרושים כדי למנוע את תעלות הניקוז, הבארות, התעלות הפרטיות או תעלות ההשקאה שבקרקעות אלה מלספק מקומות גידול ליתושים.
(2)המנהל יכול להודיע על אותם האמצעים הדרושים בכל מקרה מסויים, או לקבוע את האמצעים בצורת הוראות כלליות.
(3)כל תעלת ניקוז חדשה בקרקעות כאלה תהא עשויה בהתאם להוראות חלק זה ולכל תקנות שיתקינו על פיו.
