7ו. פיצוי ושיפוי המדינה או הרשות הציבורית
תיקון: תשס״ה
(א)פעל עובד ציבור בסטיה חמורה מהתנהגות ראויה של עובד ציבור, זכאית המדינה או הרשות הציבורית, לפי הענין, על אף הוראות סעיף 7א –
(1)אם ביצע כלפיה עובד הציבור מעשה המקים אחריות בנזיקין – לפיצוי ממנו;
(2)אם נמצאה אחראית למעשה שעשה עובד הציבור – לשיפוי ממנו.
(ב)בהליכים על שיפוי לפי סעיף זה יהיו דמי השיפוי בסכום שיקבע בית המשפט על פי הצדק והיושר.
