5ד. סייג לעיסוק
תיקון: תשנ״א־5, תשס״ט
(א)בעל תפקיד לא יעסוק בגבייה של חובות, במישרין או בעקיפין, לא בעצמו ולא על ידי קרובו או שלוחו, אלא מכוח הטלת תפקיד ביצוע על ידי מנהל לשכת הוצאה לפועל; לענין זה, ”קרוב“ – בן זוג, הורים, אחים וילדים.
(ב)האמור בסעיף קטן (א) לא יחול על פעולות שנעשו במסגרת עיסוקו של בעל תפקיד כעורך־דין או כמתמחה.
