113. זכותו של דייר משנה יוצא לדמי מפתח
(א)דייר משנה יוצא שנתן דמי מפתח בעד המושכר זכאי לחלקו בדמי המפתח לפי הכללים הקבועים בסעיפים 75 ו־76, אולם רשאי בית הדין להקטין את חלקו אם ראה זאת לצודק בנסיבות הענין.
(ב)דייר משנה יוצא שלא נתן דמי־מפתח בעד המושכר אינו זכאי לכל חלק בדמי המפתח, אולם רשאי בית הדין לקבוע לדייר המשנה היוצא חלק בדמי־המפתח בשיעור שימצא לצודק בנסיבות הענין.
