בית עסק מן הסוגים שלגביהם חלים דמי שכירות מרביים לפי סעיף 52א והוא נמצא בבנין שבנייתו הושלמה אחרי כ״ח בטבת תש״ו (1 בינואר 1946) והיתה כרוכה בהוצאות בלתי רגילות בגלל אפיו המיוחד של הבנין או בגלל שכלולו, דמי השכירות שלו יכולים לעלות על דמי השכירות המרביים לפי סעיפים 52א ו־54.
