12ה. קביעת עונש מזערי – הוראת שעה
תיקון: תשפ״ד
(א)הורשע אדם בעבירה לפי סעיפים 12א(ג), (ג5) או (ג6), 12ב2 או 12ב3, לא יפחת עונשו מרבע העונש המרבי שנקבע לאותה עבירה, אלא אם כן החליט בית המשפט, מטעמים מיוחדים שיירשמו, להקל בעונשו; עונש מאסר לפי סעיף קטן זה לא יהיה, בהעדר טעמים מיוחדים, כולו על־תנאי.
(ב)הוראות סעיף זה יעמדו בתוקפן עד יום כ״ד בניסן התשפ״ז (1 במאי 2027).
