1. איסור
תיקון: תשס״ה
(א)לא ימכור אדם ולא יפיץ ספרי תורה או מגילות תוך הצגתם ככשרים אלא אם כן הם כשרים לפי דין תורה.
(ב)לא ימכור אדם ולא יפיץ תפילין או מזוזות אם לא אישרה הרבנות הראשית או רבנות מקומית את כשרותם.
2. עונשין
תיקון: תשס״ה
העובר על הוראות חוק זה, דינו – מאסר שנה או קנס כאמור בסעיף 61(א)(2) לחוק העונשין, התשל״ז–1977, ואולם לענין סעיף 1(ב) תהיה זאת הגנה טובה לנאשם אם יוכיח שהתפילין או המזוזות היו כשרים.
3. ביצוע ותקנות
שר הדתות ממונה על ביצוע חוק זה והוא רשאי להתקין תקנות לביצועו, לרבות תקנות בדבר הסימון של אישור הרבנות על תפילין ומזוזות או במצורף אליהם.
פורסמו תקנות למניעת הונאה בתפילין ובמזוזות (סימון), תשל״ה–1975.
נתקבל בכנסת ביום ה׳ בכסלו תשל״ה (19 בנובמבר 1974).
