44. הדין החל בבית המשפט
(א)בית המשפט ידון לפי דיני המקרקעין שהם בתוקף בשעת הדיון, ויתחשב בזכויות למקרקעין הן לפי הדין והן לפי היושר.
(ב)בית המשפט לא יהא חייב לנהוג לפי כללי החוק העותמני האוסרים על בתי המשפט לדון בתביעות המבוססות על מסמכים שלא נרשמו או לפי דיני הראיות העותמניים.
