45. קביעת תובע ונתבע
בסכסוך שאף אחד מהצדדים לא ביקש להיות בו תובע, רשאי בית המשפט לקבוע את התובע ואת הנתבע ולציין את האנשים שכל אחד מהם ייצג במשפט.
