על אף הוראות סעיף 2, נפטר עובד או נבחר בגוף ציבורי או עובד או נבחר שכיהנו בעבר בגוף ציבורי, לרבות בני משפחתם, רשאי המנהל של אותו גוף ציבורי או מי מטעמו, לפרסם מודעת אבל בשם הנהלת הגוף הציבורי.
