מושעה שהורשע בבית הדין ופוטר עקב ההרשעה, תקופת השעייתו לא תבוא בחשבון לצורך קביעת פיצויי הפיטורים, אולם אלה יחושבו לפי המשכורת הקובעת בחודש ההשעיה האחרון שלפני הפיטורים.
